Rights of home ownership

Ownership of a home, such as a house or a flat, gives a home owner exclusive rights over the property.

As a new home owner you are now entitled to use your home as you see fit. You can renovate, preserve, sell or rent if you like, just keep all changes in accordance with zoning and building codes of your area.

The owner is entitled to possess and occupy his or her property which means that you won’t need permission to paint your exterior walls, or even to charge rent.

The only situation in which permission is needed is when a certain action affects the municipality or your neighbours.  

If you own property through a sectional title scheme, you have rights to your unit internally, and any other changes will be made through a body corporate at their approval.

Owners in sectional title can only change the management rules by means of a unanimous resolution.
